TallsAwayDay

Terms of Service

Last updated 19 September 2026

These terms govern your use of AwayDay, provided by Talls ("we", "us", "our"). By creating an account or using AwayDay, you agree to these terms. If you're accepting them on behalf of a company, you're confirming you have the authority to do so.

What this actually is, right now

AwayDay is a personal side project I'm building in my own time, under my own small company, Talls. It's still early - there's no paid service running yet, no staff, and no current plans to turn it into a full-time business. If you're using it today, it's being shared informally and free of charge while it's still being developed. This Terms of Service and the accompanying Privacy Policy are here simply to be clear and responsible about how your data is handled in the meantime.

1. The service

AwayDay is a leave, working-from-home and shift-tracking tool. It works fully offline with data stored only in your browser, or optionally synced to the cloud so a team can share and edit the same calendar live. You choose which mode to use.

2. Accounts

You're responsible for the accuracy of the information you give us and for keeping your login credentials secure, including any two-factor authentication method you set up. Tell us immediately if you suspect unauthorised access to your account.

3. Your data

Any data you or your team enter into a workspace (team names, people, absence records, notes) belongs to you. We don't claim ownership of it, and we don't use it for anything beyond providing the service to you, as described in our Privacy Policy. Where you use AwayDay to store information about your own employees, you remain the data controller of that information under data protection law, and we act as a data processor on your behalf.

4. Acceptable use

You agree not to: use AwayDay for anything unlawful; attempt to bypass, probe or breach its security; interfere with other customers' use of the service; or resell or provide access to AwayDay to third parties without our agreement.

5. Fees and plans

AwayDay is offered on a small number of plans (Free through to Platinum), described within the app. Fees, where they apply, are currently arranged directly and invoiced manually rather than charged automatically. We'll agree pricing with you before charging anything, and we'll give you reasonable notice before changing prices on an existing plan.

6. Suspension and termination

You can stop using AwayDay, or ask us to delete your workspace, at any time - contact us and we'll action it. We may suspend or terminate a workspace that breaches these terms, is used unlawfully, or (for a paid plan) has outstanding non-payment, and we'll try to give you notice and a chance to export your data first wherever reasonably possible.

7. Availability and support

We aim to keep AwayDay available and reliable, but as a small, growing product we don't currently offer a formal uptime guarantee (SLA). Support is available at awayday@talls.co.uk, best-effort rather than a guaranteed response time.

8. Liability

AwayDay is provided "as is". To the extent permitted by law, we're not liable for indirect or consequential losses (like lost profits or lost business opportunities), and our total liability to you for any claim is limited to the amount you've paid us in the 12 months before the claim arose. Nothing in these terms limits liability that can't legally be limited, such as for fraud or death or personal injury caused by negligence.

9. Changes to these terms

We may update these terms from time to time, for example as the product changes. We'll post the updated version here with a new "last updated" date; continuing to use AwayDay after that means you accept the changes.

10. Governing law

These terms are governed by the law of England and Wales, and any disputes will be handled by the courts of England and Wales.
